Despite an Illinois marital communications privilege statute, Julia Hudson, sister of Jennifer Hudson and the estranged wife of William Balfour, will testify for the upcoming murder trial.
According to the Chicago Tribune, Hudson will testify about a number of threats Balfour made prior to him allegedly killing her brother, son and mother in October of 2008.
She has previously told police Balfour had threatened to kill her and her family over twenty times because he was angry over the state of their marriage. She later admitted he was upset that she was seeing another man, according to prosecutors.
While Hudson’s testimony will be used, statements Balfour made to her about her new lover won’t be admissible to court. Judge Charles Burns rejected the prosecution’s request to play those conversations and threats made due to the marriage communications privilege statute. Burns however noted that Balfour’s threats to her family are “common sense” exceptions to the statute.
In new developments, Hudson told prosecutors Balfour said “she would be the last to die” when he killed her family.
Hudson and Balfour separated in February of 2008.
Jennifer Hudson is also expected to testify when the trial takes place in April.
