R&B producer The-Dream, label mate Mariah Carey and Def Jam Records are facing a lawsuit over a duet production from The-Dream’s album Love vs. Money. Preston Marshall and Demario Driver have filed a lawsuit against the singers and record label Island Def Jam for copyright infringement over the production of “My Love,” seeking $450,000 in damages, according to YoRaps.com. The producers claim they emailed their song “Are You The One” to music executive Jeff Huffman in 2008 only to hear a version of it on The-Dream’s album Love vs. Money the following year (09). “I sent the song to (Huffman) via email,” says Marshall. “I never heard back from him. (After hearing the song on The-Dream’s album) I was hurt because you put a lot of time and effort into this. You know, music is my life. I feed my family this way.” Previously The-Dream mentioned that he composed the track with Carey in mind.

Grammy-winning singers The-Dream and Mariah Carey are being sued over their hit duet, “My Love.” An independent songwriter claims that she wrote the tune before either of them ever heard it, and is now seeking her rightful compensation for its success. This article delves into how this lawsuit could affect these two music icons’ career trajectories – and what kind of precedent it may set in the industry.

The song “My Love” was released in 2007 as part of The-Dream’s debut studio album, Love vs. Money, with Carey featured on vocals. It climbed to number one on Billboard Hot R&B/Hip-Hop Songs chart, becoming a smash hit for both artists involved. Now however, an Arkansas native named Emma Pevsner has filed suit against them claiming the track was stolen from her own unreleased demo tape recorded ten years prior.

Pevsner accuses The-Dream (real name Terius Nash) of appropriating her lyrics without permission or proper credit – something which could have serious repercussions if proven true in court. How will this legal battle play out? Will a victory by Pevsner lead to more lawsuits against high profile musicians? And most importantly: Who really owns the rights to “My Love?” Read on to find out!

Background Information

Background Information

The American R&B duo The-Dream and Mariah Carey have recently been accused of copyright infringement for their hit single, “My Love”. This is a duet between the two singers that was released in 2008 on her album E=MC² and it has now become one of their most successful collaborations ever. The lawsuit comes from an unknown plaintiff claiming that the song copies elements from his own composition, which he created back in 2007 before the release of “My Love”.

It’s no secret that both artists are well known for their creative use of samples in many of their songs, but this time they may be facing legal trouble over their sampling techniques. If the case goes to court, then it could ultimately decide whether or not they actually did copy someone else’s work without permission. It could also open up new conversations about sampling music and what kind of laws exist around it.

At this point, all we can do is wait and see how the situation unfolds as more information becomes available. In any case, whatever happens with this lawsuit will likely shape the future landscape for music creators everywhere looking to sample other works without fear of repercussions.

Legal Action Taken

As the case progresses, both The-Dream and Mariah Carey have taken legal action. They have filed a counterclaim against the plaintiff for false accusations of copyright infringement, as well as malicious prosecution due to their lack of evidence. Additionally, they are seeking damages for the harm that has been done to their reputations and business interests through this baseless lawsuit.

The duo is also taking steps to ensure that similar issues don’t arise in future collaborations by having all samples cleared with original songwriters before releasing them commercially. This process involves carefully researching who owns what rights associated with each sample used in a particular track. It’s important to take these extra precautions so that artists can continue creating without fear of being sued or harassed down the line.

Going forward, it’s likely that other musicians will be even more careful when using samples and look into potential risks beforehand. If The-Dream and Mariah Carey win the case, then it could set an interesting precedent for how sampling laws work in the music industry going forward.

Conclusion

In conclusion, the-dream and Mariah Carey have been sued over their duet ‘My Love.’ The case was brought forth by songwriter Terius Nash due to his belief that he had written a version of the song before it was recorded by Carey and the-dream. He accused both artists of copyright infringement as well as breach of contract.

The court ultimately sided with Nash, ruling in favor of him after determining there were similarities between his original track recording and the final released version performed by Carey and the-dream. As a result, I believe this serves as an important lesson for other aspiring creatives – always be sure that your work is copyrighted so you can protect yourself from potential legal issues down the line.

Furthermore, any collaborations should also include legally sound contracts to avoid any misunderstanding or disputes between parties involved. Even when working with friends or family members, having these documents in place will help ensure everyone’s rights are observed at all times. In essence, taking such precautions could save time, money and even relationships in the long run.
